Personal/caregiver leave continues to arise when an employee takes personal/paid care leave or paid annual leave. The compassionate leave and leave of the personal guardian will not be taken into account on unpaid leave, unless it is a community service leave or if it is provided for in a bonus or agreement. Compassionate leave must be requested/agreed with the employer. In other words, it is up to the employer to decide whether the reasons for the leave are important. The employer must treat compassionate leave applications objectively and rightly, and no external considerations are taken into account. The same issues must be dealt with in the same way. When paid personal/caregiver leave is taken, the minimum requirement is that a worker must be paid at his base salary for the regular hours he would have worked during the period. The “basic wage” of a salaried worker (with the exception of a worker on the agreement) is the rate of pay to be paid to a worker for his ordinary hours of work, but not with the following: A worker (including a casual worker) is entitled to two days of compassionate leave to spend time with a family member or household who has suffered a life-threatening illness or injury. After the death of an immediate family member or the worker`s household, compassionate leave may also be taken. This leave period applies to the management of unexpected problems and emergencies concerning the creditor, including departure to arrange or attend a funeral. Employers may treat bereavement leave with illness or leave, depending on individual circumstances.

Employers and workers are in the best position to discuss leave options. Personal/care leave accumulates year after year. If you opt for a compassionate leave policy, you must decide whether you pay employees while they are eliminated. For all periods of personal leave or care or compassionate leave, the worker must inform his employer of the acceptance of this leave.
